The rights of airline passengers are governed internationally by the Montreal Convention signed in 1999. In Europe it is the regulation that came into force on 17 February 2005 and adopted in 2004 authoritative. All flights words "European", whether agency or purchased directly from the company obey the following rules.
What is a European flight?
Are designated as "European flights" those departing from an airport located in a Member State of the European Union, regardless of the airport of arrival. Conversely, flying to a member country, regardless of the country of departure, is also considered European, as long as the airline or it European.
And for other flights?
In this case, it is the law of the country of departure applies.

Under what circumstances can I get a refund?
You have arrived at the airport just in time ... to learn that your flight had been canceled. One always painful mishap which nevertheless gives you at least a full refund of your ticket and, whatever the reason for the cancellation. And provided that you give up your flight.
For so-called flight "European" passenger rights are reinforced by the settlement of 2005. The carrier thus obliged to offer you one of the following options:
- Reimbursement of the ticket price bought within seven days. If your flight was canceled during its course, the carrier must re-route you to your departure airport if the airport is different, it has to pay the transfer.
- Reforward another to your final destination under equivalent conditions as soon as possible or, if you wish, to another date.
In all cases of cancellation, you have the right to be reimbursed, however the European regulation sets limits damages.
If the start was prevented by a force majeure (neither strike nor damage the plane are a) the company must prove that it was: an external, unforeseeable that it was impossible to overcome.
How to get compensation?
In addition to the refund, you can ask for damages if there were financial or moral damage. For European flights, a lump sum is provided for the settlement of 1995 (between € 250 and € 600 depending on the flight) only if you have not been informed of the cancellation at least two weeks before departure and no another theft was available between 2 weeks and seven days before departure.
Caution: some companies are spending cancellations delays. If you change your registration ticket and the flight number has changed, know that your flight was actually canceled. Remember to keep your first ticket to assert your rights.

But what kind of late? One hour? Six hours? No legal text defines exactly from when a delay is considered as such.
For an international flight?
You have the right to compensation which shall not exceed 4,800 euros. The Montreal Convention (which only applies to flights operated by the companies in which the state has signed) states that the carrier is liable for damage occasioned by delay in the carriage. Not to compensate you he must prove that "he and his servants and agents took all measures that could reasonably be required to avoid the damage."
For a flight called "European"?
The regulation provides better protection for users of European flights. The carrier has a duty to take care of passengers if the delay exceeds:
- Two hours for a flight of 1500 km,
- Three hours for intra-Community flights of more than 1500 kms and other flights of between 1 500 km and 3000 km,
- Four hours for other flights.
In all cases refreshments and the opportunity to restore should be offered to delayed passengers, as well as the opportunity to spend two phone calls for free, or to send two telex, fax or two two emails.
If the flight is postponed to the next day, the accommodation must also be provided.

Overbooking: what are your rights?
You have completed all the steps in the rules (confirmation and arrived on time) and yet you are denied boarding. This may be a common practice called overbooking and related to the management of airline seats. In general, at the time of boarding call for volunteers is done.
If you do not volunteer to board the plane (an appeal must be made by the boarding staff) you have to negotiate yourself your support and your compensation.
If you are not a volunteer, your rights are the same as if the flight had been canceled.
Note: You can also refuse boarding "for security reasons"
How to enforce your rights?
You have suffered injury and want to assert your rights? You can start by start negotiations amicably with your airline. Do not hesitate to get help from a consumer association. They are used to treat this type of problems.
If you do not hear with your carrier, you can file a complaint against the airline and seek redress from the court of the registered office of the carrier or the place of destination where you went. You have two years after the dispute (according to the Montreal Convention) to file a complaint regarding the delays for passengers or luggage.
